/PRNewswire-USNewswire/ -- Today Americans for Tax Reform (ATR) released a taxpayer timeline of President Obama's first 50 days in office:
January 20: The Dow opens at 8,279.63. Obama is inaugurated. The Dow falls 330 points.
January 26: Treasury Secretary Tim Geithner is confirmed despite his tax problems.
February 2: In order to ensure "What happens in Chicago, stays in Chicago" by preventing corruption and kickbacks arising from the "stimulus" bill, ATR asks each Member of Congress planning to vote for the bill to sign a statement promising that they, their family, and the members of their staff will not personally benefit from the bill. All refuse.
February 3: Health & Human Services Secretary-designate Tom Daschle withdraws his nomination due to tax problems. Chief Performance Officer-designate Nancy Killefer withdraws her nomination due to tax problems.
February 4: On the sixteenth day of his presidency, Obama breaks one of the central promises of his campaign by singing into law a 156 percent increase in the federal excise tax on tobacco, a hike of 61 cents per pack, to take effect April 1. Obama promised repeatedly on the campaign trail that he would never raise any form of taxes on those making less than $250,000 per year, for example:
"I can make a firm pledge. Under my plan, no family making less than $250,000 a year will see any form of tax increase. Not your income tax, not your payroll tax, not your capital gains taxes, not any of your taxes"
(September 12, 2008, Dover, NH -- http://www.youtube.com/watch?v=Q8erePM8V5U )
This tax increase will fall squarely on the shoulders of the middle- and low-income Americans Obama said he would not raise taxes on: 55 percent of smokers are "working poor," one in four smokers live below the poverty line, and on average, smokers, whose median income is a little more than $36,000 make about 30 percent less than non-smokers.
February 9: Obama holds his first press conference, during which he calls for massive government spending increases. He fails to provide a single historical example where a government increased spending which led to increased jobs, income, and wealth on any sustainable basis. Obama also has the audacity to claim the "stimulus" plan is free of pet projects and earmarks:
"What it does not contain, however, is a single pet project, not a single earmark, and it has been stripped of the projects members of both parties found most objectionable."
Responding to a reporter's question as to what specific metric the American people should use to determine whether Obama's programs are working, Obama replies:
"I think my initial measure of success is creating or saving 4 million jobs."
How, exactly, does one measure a "saved" job? (See March 4 for details)
During the press conference, Obama builds expectations about the next day's planned announcement by Treasury Secretary Geithner.
February 10: Instead of presenting the promised specific plan, Geithner instead offers vague statements and echoes FDR's economically paralyzing "bold, persistent experimentation" philosophy with this gem:
"We will have to adapt our program as conditions change. We will have to try things we've never tried before. We will make mistakes. We will go through periods in which things get worse and progress is uneven or interrupted."
The Dow falls 380 points.
February 12, sometime around 10:00 PM: The "Stimulus" conference report is completed behind closed doors. Less than sixteen hours pass before the bill is taken up by the House.
Friday, February 13
2:24 PM: With not a single Member voting for the bill having claimed to have actually read it, the House passes the conference report for H.R.1, the "American Recovery and Reinvestment Act of 2009."
5:29 PM: With not a single Member voting for the bill having claimed to have actually read it, the Senate passes the conference report for H.R. 1.
The Dow falls 82 points.
February 17: Obama signs the "Stimulus" bill and violates his pledge to the American people that he will allow legislation to be posted online for five full days before signing it. The stimulus bill was posted for only four days, not five.
"No more secrecy. ... when there's a bill that ends up on my desk as president, you, the American voter, will have five days to look online and find out what it is before I sign it, so that you know what your government's doing."
(June 22, 2007. Manchester, New Hampshire, http://tinyurl.com/dl2wog)
The Dow falls 293 points.
February 24: Obama makes his first address to a joint session of Congress and claims he doesn't believe in "bigger government." Obama also says he is proud that "we passed the recovery plan free of earmarks."
February 25: The first trading day after Obama's address, the Dow drops 78 points.
February 26: Obama releases his budget outline which raises taxes on individuals, small businesses, capital gains, dividends, and foreign source profits of corporations while eliminating several energy tax credits.
The budget also calls for a "cap and trade" regime which makes an absolute mockery of Obama's central campaign promise not to raise any form of taxes on those making less than $250,000 per year.
Obama also shatters his campaign promise to enact net spending cuts during his administration:
"So we're going to have to make some investments but we've also got to make spending cuts, and what I've proposed -- you'll hear Senator McCain say 'he's proposing a whole bunch of new spending' -- but, actually, I'm cutting more than I'm spending. So that it will be a net spending cut."
(Oct. 7, 2008. Second Presidential Debate - http://www.youtube.com/watch?v=eM0Eri8VWiw)
The Dow drops 86 points.
March 1: The Obama administration foreshadows another broken promise when Peter Orszag, appearing on This Week with George Stephanopoulos, claims the 8,000 earmarks in the 2009 Omnibus are "last year's business. We just need to move on."
To say the least, this is not consistent with Obama's campaign promises on earmarks and "change":
"And, absolutely, we need earmark reform. And when I'm president, I will go line by line to make sure that we are not spending money unwisely."
(Oct. 14, 2008. First Presidential Debate)
March 3: Obama compares the stock market to a political daily tracking poll:
"The stock market is sort of like a tracking poll in politics. It bobs up and down day-to-day," Obama said. "And if you spend all your time worrying about that, then you're probably going to get the long-term strategy wrong."
Obama also indicates to union leaders he will sign "card check" legislation.
The Dow drops 38 points.
March 4: While testifying before the Senate, Treasury Secretary Geithner is challenged by Finance Committee chairman Max Baucus (D-MT) as to the invention by the Obama administration of a new metric -- "creating or saving" jobs -- the very same metric Obama claimed on Feb. 9 is the most important measure of success:
"You created a situation where you cannot be wrong. If the economy loses 2 million jobs over the next few years, you can say yes, but it would've lost 5.5 million jobs. If we create a million jobs, you can say, well, it would have lost 2.5 million jobs," Baucus said. "You've given yourself complete leverage where you cannot be wrong, because you can take any scenario and make yourself look correct."
March 4: CNN visits the site of the first "stimulus" dollars to hit the ground: A $8.5 million bridge serving the town of Tuscumbia, Missouri - population 223.
March 5: While testifying before the House, Treasury Secretary Geithner concedes Obama's budget raises taxes on small businesses, but focuses on a meaningless metric: the percentage of small businesses affected rather than the fact that two-thirds of small business profits will be subject to higher taxation.
The Dow falls 279 points.
March 9: The Dow closes at 6,547.05. From Inauguration Day to March 9, the Dow is down 1,732.58, a 21 percent drop.

If Majority Leader Reid Supports E-Verify Why Does the Senate Block Its Long-Term Reauthorization?
/PRNewswire-USNewswire/ -- For the second time in as many months, the United States Senate had an opportunity to reauthorize the highly effective E-Verify system and chose not to. By rejecting an amendment to the Omnibus Appropriations bill offered by Sen. Jeff Sessions (R-Ala.) to extend E-Verify through 2014, the Senate leadership belied their contention that they support this program that protects U.S. workers from losing jobs to illegal aliens.
E-Verify is a federal program that allows employers to voluntarily determine whether workers are legally authorized to work in the U.S. by electronically verifying their Social Security numbers. According to the Department of Homeland Security, E-Verify has a 99.6 percent accuracy rate.
In a letter to his Nevada constituents, Majority Leader Harry Reid states, "I strongly support programs like E-Verify that are designed to ensure that employers only hire those who are legally authorized to work in the United States, and believe we need to strengthen enforcement against employers who knowingly hire individuals who are not authorized to work." In fact, in 2006 and 2007, Senator Reid supported not only reauthorizing E-Verify, but making it mandatory for all employers nationwide.
But now, Sen. Reid and the Democratic leadership are singing a different tune:
-- In February, Sen. Reid blocked inclusion of amendments to the economic
stimulus bill that would have reauthorized E-Verify for five years,
and required that employers who receive stimulus money use E-Verify to
ensure they hire only legal U.S. workers. These provisions were
included in the House bill.
-- During the House-Senate conference committee finalizing the economic
stimulus package, Sen. Reid, together with Speaker Nancy Pelosi,
stripped the E-Verify provisions from the bill sent to President
Obama.
-- Today, Sen. Reid and the Democratic majority voted down Sen. Sessions'
five year reauthorization of E-Verify.
Because of these actions, the vital protections that E-Verify offers to American workers at a time when unemployment is rising rapidly are on tenuous life support only until September 30. They also confirm that Senate leadership's primary interest in E-Verify is to use it as a bargaining chip in an effort to gain amnesty for illegal aliens.
"If the Senate leadership were truly interested in protecting American jobs from being filled by illegal aliens, E-Verify would have been reauthorized for five years and steps would have been taken to make its use mandatory by all employers," said Dan Stein, president of the Federation for American Immigration Reform (FAIR).
"The fact that E-Verify will only receive a six-month reauthorization, and the fact that employers receiving taxpayer stimulus money are not required to verify that workers are legal U.S. residents is not an oversight. It is a deliberate decision of the Senate leaders who place the interests of low wage employers and illegal aliens over the interests of millions of unemployed American workers who desperately need jobs.
"The defeat of the Sessions amendment demonstrates conclusively that the Senate leadership, contrary to what they say, is unwilling to protect the jobs of American workers," Stein concluded.

Isakson Denounces Legislation to Eliminate Workers’ Rights to Secret Ballot in Choosing Whether to Unionize
During a hearing in the Senate Health, Education, Labor and Pensions Committee, U.S. Senator Johnny Isakson, R-Ga., today strongly criticized legislation that would strip workers of their right to a secret ballot when deciding whether to unionize.
“There is no evidence that forced unionization will do anything to assist the middle class and deliver economic security for workers,” Isakson said. “Bipartisan compromise can and should occur when both sides share a common goal. However, I cannot and will not support this anti-growth, anti-worker legislation.”
The so-called Employee Free Choice Act, which is expected to be introduced in the Senate today, would eliminate the rights of workers to participate in a secret-ballot election in order to certify the creation of a union. Instead, the legislation would force employees to make a public declaration of their preference by allowing union organizers to bypass elections if a majority of employees sign cards authorizing a union.
Isakson believes the current system, which allows employees to use a secret ballot in choosing whether they want a union to become their exclusive representative in the workplace, has worked well because it neither advocates nor discourages unionization.
Moreover, the legislation would force employers and employees to enter into binding arbitration, whereby they must accept what is essentially a federal bureaucrat’s best estimate in defining a fair and prudent contract. In addition, this legislation would provide for mandatory injunctions for unfair labor practices during organizing efforts.
“Support for this legislation is based on the fear that, if left to their own devices in the privacy of a voting booth, some American workers might choose not to join a union,” Isakson said. “This legislation creates a situation of worker intimidation and prohibits the ability of management and labor to work together in an increasingly dynamic economy.”

RNC: 50 Days: No Golden Anniversary
/PRNewswire-USNewswire/ -- The following was released today by the Republican National Committee:
In 50 Days, Democrats Have Passed And Proposed Roughly $5 Trillion In Government Spending:
President Obama Proposed Spending Between $3.5 And $4 Trillion In His FY2010 Budget. "Obama's budget overview will call for between $3.5 trillion and $4 trillion in spending in fiscal year 2010 and creates space for up to $750 billion in additional bank bailout funds this year - money that hasn't been requested and the administration hopes will not be necessary to stabilize the still-reeling financial system." (Major Garrett, "Obama's Budget Projects $1.75 Trillion Deficit," FoxNews.com, www.foxnews.com, 2/26/09)
Last Month, President Obama Signed The $787 Billion Economic Stimulus Package. "The $787 billion stimulus bill that President Barack Obama signed Tuesday was a warm-up act, an emergency provision aimed at stimulating a moribund economy." (David Lightman and Margaret Talev, "How Much Government Spending Is Ahead? Stay Tuned," The Miami Herald, 2/20/09)
Democrats In The House Passed A $410 Billion Omnibus Spending Bill. "The U.S. House voted to boost spending on domestic programs by 8 percent, ease restrictions on travel to Cuba and kill a school voucher program in Washington, D.C., as part of a $410 billion spending bill." (Brian Faler, "House Approves $410 Billion 'Omnibus' Spending Bill," Bloomberg, 2/25/09)
President Obama Announced A $275 Billion Plan To Stave Off Foreclosures. "After a week dominated by programs that involve spending -- in addition to the stimulus package, the plan to stave off foreclosures could cost taxpayers as much as $275 billion -- Mr. Obama used his weekly radio and Internet address to chart the immediate road ahead." (Sheryl Gay Stolberg, "Obama Pledges To Seek Deficit Cuts," The New York Times, 2/21/09)
OBAMA SNUBBED THE BRITISH PRIME MINISTER
President Obama's Handling Of The British Prime Minister's Trip To The U.S. Was "Appalling":
During British Prime Minister Gordon Brown's American Trip, He Presented President Obama With A Priceless Pen Holder; Obama Reciprocated With 25 DVDs. "After Brown presented Obama with a pen holder crafted from the timbers of the 19th century British warship HMS President (whose sister ship, HMS Resolute, provided the wood for the Oval Office's desk), Obama offered up ... 25 DVDs of American movie classics." (David Saltonstall, "London Aghast At President Obama Over Gifts Given To Prime Minister Brown," [New York] Daily News, 3/7/09)
President Obama's Handling Of Brown's Visit: "Appalling." "His handling of the visit of the Prime Minister, Gordon Brown, to Washington was appalling." (Iain Martin, "President Barack Obama Dislikes Britain, But He's Keen To Meet The Queen," The [UK] Daily Telegraph's "Iain Martin" Blog, www.telegraph.co.uk, 3/6/09)
Originally, Brown Was Not Granted A Press Conference, Then One Was Thrown Together At The Last Minute. "First Brown wasn't granted a press conference with flags, then one was hastily arranged in the Oval office after the Brits had to beg. Obama looked like he would rather have been anywhere else than welcoming the British leader to his office and topped it all with his choice of present (*) for the PM." (Iain Martin, "President Barack Obama Dislikes Britain, But He's Keen To Meet The Queen," The [UK] Daily Telegraph's "Iain Martin" Blog, www.telegraph.co.uk, 3/6/09)
OBAMA HAS HAD ISSUES STAFFING HIS ADMINISTRATION
President Obama Has Had Difficulties Appointing People To Fill Top Positions In His Administration:
Seven Weeks After Inauguration, President Obama Still Has To Fill Hundreds Of Senior Level Positions In The Executive Branch. "Nearly seven weeks after taking office, President Barack Obama has a Cabinet, but hundreds of other senior-level jobs across the executive branch lack permanent occupants." (Dave Helling, "Across Nation's Capital, Vacant Offices Abound," The Kansas City Star, 3/8/09)
"But Mr. Obama Lost Four Nominees To Tax And Other Issues And The Pace Of Appointments Slowed." (Peter Baker, "Obama Team Has Billions To Spend, But Few Ready To Do It," The New York Times, 2/17/09)
Treasury Secretary Tim Geithner Failed To Pay Taxes While Working For The International Monetary Fund. "Timothy Geithner didn't pay Social Security and Medicare taxes for several years while he worked for the International Monetary Fund, and he employed an immigrant housekeeper who briefly lacked proper work papers." (Jonathan Weisman, "Geithner's Tax History Muddles Confirmation," The Wall Street Journal, 1/14/09)
Health And Human Services Secretary Nominee Tom Daschle Withdrew His Nomination After Reports That He Had Failed To Pay Taxes. "Former Sen. Tom Daschle has withdrawn his nomination to head the Department of Health and Human Services, according to a statement Tuesday from the White House. ... Daschle, the former Senate majority leader, apologized Monday for failing to pay his taxes in full. He said earlier he was 'deeply embarrassed' for a series of errors that included failing to report $15,000 in charitable donations, unreported car service and more than $80,000 in unreported income from consulting." (Ed Henry and Kristi Keck, "Daschle Withdraws As HHS Nominee," CNN, 2/3/09)
Nancy Killefer Withdrew Her Nomination For Tax Problems Dating Back To 1995. "They knew about Nancy Killefer's tax problem from 1995, yet they nominated her for a post in the office of management and budget anyway. This morning she withdrew." (Sam Donaldson, Op-Ed, "Sam On What Nominees' Withdrawal Says About Obama," ABC News, 2/3/09)
Commerce Secretary Nominee Bill Richardson Withdrew His Nomination After Reports That State Contracts In New Mexico Were Under Investigation. "First, they knew about Gov. Bill Richardson's potential problem in the New Mexico investigation into state contracts, but they nominated him to be commerce secretary anyway. Weeks later, of course, Richardson withdrew." (Sam Donaldson, Op-Ed, "Sam On What Nominees' Withdrawal Says About Obama," ABC News, 2/3/09)
During The Campaign, Obama Said Lobbyists Wouldn't Run His White House Or Work For Agencies They Used To Lobby:
During His Campaign, President Obama Promised To "Stop The Revolving Door That Lets Onetime Lobbyists Go To Work For The Federal Government." "[O]n the campaign trail, Obama vowed to stop the revolving door that lets onetime lobbyists go to work for the Federal Government and oversee contracts that could harm -- or help -- their former employer." (Mark Thompson, "Obama's Lobbyist Ban Meets A Loophole: William Lynn," Time, 1/27/09)
President Obama Signed An Executive Order Banning Lobbyists From Working For Agencies They Used To Lobby. "And one of the first things the new President did in office was seemingly make good on that promise, signing an Executive Order barring former lobbyists from joining his Administration to work at agencies they recently lobbied." (Mark Thompson, "Obama's Lobbyist Ban Meets A Loophole: William Lynn," Time, 1/27/09)
But President Obama Has Appointed Numerous Former Lobbyists:
President Obama Has Appointed At Least 21 Former Federal Registered Lobbyists, Including Agriculture Secretary Tom Vilsack. "A USA TODAY review of Obama hires shows that 21 have registered as federal lobbyists, although most have not done so within the past two years. They include White House aide Cecilia Munoz, who lobbied last year for the National Council of La Raza, and Agriculture Secretary Tom Vilsack, who lobbied in 2007 for a national teachers union." (Fredreka Schouten, "Geithner Names Ex-Lobbyist As Treasury Chief Of Staff," USA-region> Today, 1/27/09)
OBAMA HAS FAILED ON EARMARK REFORM
President Obama Promised To Slash Earmarks And Stop Wasteful Spending:
President Obama Pledged To "Slash Earmarks." "Slash Earmarks: ... In the past two years, the Democratic Congress has cut earmarks nearly in half, to $17.2 billion in 2008. Obama and Biden are committed to returning earmarks to less than $7.8 billion a year." (Obama For America, Blueprint For Change, www.barackobama.com, p. 20, Accessed 2/19/09)
During The Campaign, President Obama Pledged To "Go Line By Line" And "Eliminate Programs That Don't Work." Obama: "I want to go line by line through every item in the federal budget and eliminate programs that don't work, and make sure that those that do work work better and cheaper." (Sen. Barack Obama, NBC Presidential Debate, Nashville, TN, 10/7/08)
-- Obama: "Earmarks account for 0.5 percent of the total federal budget.
There's no doubt that the system needs reform and there are a lot of
screwy things that we end up spending money on, and they need to be
eliminated. But it's not going to solve the problem." (Sen. Barack
Obama, CNN Presidential Debate, Hofstra University, New York,
10/15/08)
But President Obama Signed An Economic Stimulus Package Full Of Wasteful Spending And Democrats Are Pushing A $410 Omnibus With More Than $7 Billion In Earmarks:
Despite Promises, The Stimulus Is Not Free Of Money For Special Interests. "The compromise stimulus bill adopted by House and Senate negotiators this week is not free of spending that benefits specific communities, industries or groups, despite vows by President Obama that the legislation would be kept clear of pet projects, according to lawmakers, legislative aides and anti-tax groups." (Dan Eggen and Ellen Nakashima, "Despite Pledges, Package Has Some Pork," The Washington Post, 2/13/09)
The Senate Is Working On The $410 Billion Omnibus Spending Bill That Contains 8,750 Earmarks Worth $7.7 Billion. "The Senate is getting ready to pass a giant spending bill stuffed with congressional pet projects that critics decry as unnecessary pork. ... They point to stiff resistance from Democratic leaders and Obama's reluctance to veto the pending $410 billion legislation as signs that business will continue as usual. The 8,570 earmarks in the bill represent $7.7 billion, according to the nonpartisan group Taxpayers for Common Sense." (Dan Nowicki, "Earmark-Laden Bill A Line In The Sand For Pork-Barrel Politics," The Arizona Republic, 3/6/09)
DEMOCRATS HAVE FAILED TO BRING BIPARTISANSHIP TO WASHINGTON
President Obama Said Political Opponents Should Work Together Instead Of Demonize Each Other:
Obama Derided Partisan Politics And Said Political Opponents Should Come Together To Solve Problems. "A politics that says it's ok to demonize your political opponents when we should be coming together to solve problems." (Sen. Barack Obama, Response To The State Of The Union, 1/28/08)
"Obama Has Said He Plans To Work With Republicans To Cut Through Partisan Gridlock That Often Blocks Legislative Progress."(Sabrina Eaton, "Ohioan An Early Obama Critic," [Cleveland] Plain Dealer, 1/29/09)
But In President Obama's Washington, Democrats Have Hardly Come Together With Republicans:
Speaker Nancy Pelosi (D-CA): We Won The Election, We Wrote The Bill. "Speaker Nancy Pelosi (D-Calif.) parried GOP assaults on Democrats' $825 billion stimulus package Thursday and refused to slow the bill down to give more time for Republican input. 'Yes, we wrote the bill. Yes we won the election, but that doesn't mean we don't want sustainability or Republican support,' Pelosi said." (Steven T. Dennis, "Pelosi Defends Democrats' Vetting Of Stimulus Plan," Roll Call, 1/22/09)
Democrats Rolled Over House Republicans And "Yielded No More Than Necessary" In The Senate To Pass The Stimulus Package. "In the case of the stimulus bill, Democrats used their solid majority to roll over House Republicans and yielded no more than necessary to garner three critical GOP votes in the Senate." (Janet Hook, "Bipartisanship Faces Stiff Test," Chicago Tribune, 2/16/09)
For President Obama, "Urgency Trumps Bipartisanship." "But with the economy in crisis and the stimulus his top priority, [President Obama] also made clear that urgency trumps bipartisanship." (Todd J. Gillman, "Selling The Stimulus Bill President Discovering That Bipartisanship Has Its Limits," The Dallas Morning News, 2/10/09)
THE ADMINISTRATION HAS FAILED ON TRANSPARENCY
President Obama Pledged Transparency And Openness Before Signing Legislation:
During The Campaign, President Obama Promised To Give The American Public 5 Days To Review Legislation Before Signing Any Bill. "Sunlight Before Signing: Too often bills are rushed through Congress and to the president before the public has the opportunity to review them. As president, Obama will not sign any non-emergency bill without giving the American public an opportunity to review and comment on the White House website for five days." (Obama For America Website, www.barackobama.com, Accessed 2/19/09)
But The Obama Administration Has Failed To Allow The Public 5 Days To Review Legislation It Has Signed:
According To The Nonpartisan PolitiFact, President Obama Did Not Provide 5 Days Before Signing His First Bill, The Lilly Ledbetter Fair Pay Act. "But the first bill Obama signed into law as president -- the Lilly Ledbetter Fair Pay Act -- got no such vetting. In fact, the Congressional Record shows that the law was passed in the Senate on Jan. 22, 2009, passed in the House on Jan. 27, and signed by the president on Jan. 29. So only two days passed between the bill's final passage and the signing." (Angie Drobnic Holan, "Obama Signs First Law Without Web Comment," St. Petersburg Times' "PolitiFact," www.politifact.com, 1/29/09)
President Obama's Second Bill Signing Occurred Hours After Passed By Congress. "For his second bill, Obama signed an expansion of the State Children's Health Insurance Program, which provides health coverage for low-income children. He signed it on Feb. 4, 2009, just hours after it was finalized in Congress." (Angie Drobnic Holan, "Still No 'Sunlight Before Signing,'" St. Petersburg Times' "PolitiFact," www.politifact.com, 2/4/09)

U.S. Supreme Court Rejects Attempt To Overturn Nader Ballot Access Case
/PRNewswire/ -- In a significant move for open-election laws, the U.S. Supreme Court today rejected an attempt to overturn a federal Ninth Circuit Court of Appeals' decision that the state of Arizona could not require independent presidential candidates to register earlier than candidates affiliated with major political parties.
Arizona's petition for certiorari to the Supreme Court had been closely watched after 13 other states supported Arizona's bid to have the High Court hear the case. The federal civil rights case, originally filed in Arizona federal district court, stems from Nader's 2004 presidency bid.
Ralph Nader had challenged the deadline, contending it violated his First Amendment rights to free speech and political association. Lead Attorney Robert Barnes of the Bernhoft Law Firm represented Nader before the Ninth Circuit, which overturned the district court and unanimously declared the Arizona law unconstitutional. Nader's Bernhoft Law legal team successfully argued that requiring independent candidates to register by June was unfair when the two major political parties did not hold their conventions until the fall.
"By letting that decision stand, the U.S. Supreme Court has affirmed that American democracy hinges on giving people a voice and a choice," says Robert Bernhoft, founding partner of Bernhoft Law. "Today's decision is not only a victory for Ralph Nader, but a seminal victory for all who care about free speech, free and open elections, and a more participatory democracy."
In addition to the earlier deadline for independent candidates, the Arizona law also required that petition circulators be registered to vote in the state. "What makes this case unusually significant is that it involved two distinct, important issues, and liberalized ballot access prevailed on both," says Richard Winger, editor of the influential Ballot Access News. Winger also noted that this development could have "immediate repercussions," since ballot access cases are currently pending in 15 other states.

Utah 1st State to Give Voters Right to Constitutionally Secure Secret Ballots, Will Be on 2010 Ballot
SOS Ballot Secures Public Vote in Utah for Secret Ballot Constitutional Amendment; 1st State to Give Voters Right to Constitutionally Secure Secret Ballots Strongly Backed by Gov. Huntsman, Sen. Hatch, AG Shurtleff
/PRNewswire/ -- A constitutional amendment to guarantee the use of secret ballots in Utah elections, including in union organizing elections, has passed the Utah State Senate, ensuring a place on the November 2010 ballot. House Joint Resolution 8 was introduced in the State House by Rep. Carl Wimmer (R-Herriman), where the measure also passed with a 2/3rd vote earlier in the week. The amendment had the strong backing of Governor Huntsman, US Senator Orrin Hatch and Utah Attorney General Mark Shurtleff, and becomes the first of what is likely to be a dozen or more states to place constitutional guarantees for secret ballots before the voters. Attorney General Shurtleff is a member of the National Advisory Board of Save Our Secret Ballot, the national group organizing similar movements in states throughout the country.
SOS Ballot National Advisory Board Chairman Rep. Ernest Istook commented, "Utahans are fortunate to have leaders like Rep. Wimmer as well as Governor Huntsman, Senator Hatch and Attorney General Shurtleff who understand just how imperiled and vulnerable the right to a secret ballot is. We applaud their leadership in making this issue a top priority and look forward to working with them to make sure Utahans never have to fear losing their right to a secret ballot. While Utah is the first state, it will soon be joined by other states in giving voters the right to protect the secret ballot. We won in Utah because voters want secret ballots protected. We will win in a dozen or more states this election cycle because voters are appalled that Congress would acquiesce to the extreme demands of Union bosses and threaten the right to a secret ballot."
Similar efforts have been launched by SOS Ballot in Arkansas, Arizona, Florida, Georgia, Missouri, Nevada, North Dakota, Oklahoma, South Carolina and South Dakota with additional states soon to be announced. The 47-word amendment says:
"The right of individuals to vote by secret ballot is fundamental. Where state or federal law requires elections for public office or public votes on initiatives or referenda, or designations or authorizations of employee representation, the right of individuals to vote by secret ballot shall be guaranteed."
Utah Governor John Huntsman extended his support to HJR 8 with the following statement:
"It is ever important for Utahans to have the right to vote their conscience in areas that are critical to their democratic representation and the representation within their employment without the fear of retribution or persecution. This constitutional amendment would ensure that individuals will be constitutionally guaranteed the right to a secret ballot for these types of important election. This issue is fundamental to our economic development efforts as a State and safeguards our State's long tradition of being a 'right to work' state Â- a position that is grounded in individual rights and freedoms," he continued.
Recent public opinion polls taken in the states where SOS Ballot has announced efforts show huge public support of 81% to 94%, with Union members even more supportive of the constitutional guarantee for a secret ballot than non-union members.
The secret ballot was used locally as an act of post-Civil war southern reconstruction, first as a way to impose a literacy requirement on newly freed slaves. But the secret ballot also protected mostly black voters who faced physical intimidation, even lynching, depending on how their vote was cast. Secret ballots were first used statewide in the Massachusetts governor's race 1888 and nationally in 1892 to elect President Grover Cleveland.

Georgia Legislature Blasts O'Hare Modernization Program as Wasteful Project
/PRNewswire-USNewswire/ -- A resolution has been introduced in the Georgia Legislature calling Chicago's O'Hare Modernization Program, or OMP, a "Runway to Nowhere" and describing the project as "ill-conceived and premature." House Resolution 535 was introduced by Representative Joe Wilkinson, Chairman of the House Ethics Committee. It calls on Georgia Congressional delegation to stop all wasteful federal spending in relation to President Obama's recently approved stimulus package. The cost of OMP, which would add a third terminal to Chicago's O'Hare Airport, is currently estimated at approximately $20 billion.
"President Obama was right to warn the nation's mayors that he would call them out for spending federal tax dollars on pork. He should start with his hometown mayor," said Representative Wilkinson. "Here is a public works project that's riddled with allegations of corruption. As an extension of the Rod Blagojevich investigation, crony contractors are being charged with fraudulent bid-rigging schemes, and Chicago's mayor wants upwards of $20 billion from the American taxpayers to pay for it? If that's not pork, I don't know what is."
No one in Illinois is publicly acknowledging where the stimulus funds for the state will be used but there has been speculation that a significant portion will be used for the O'Hare Modernization Program. Chicago Mayor Richard Daley has yet to reveal how and where he would like stimulus funds to be used. Given that the state of Illinois will not invest in the project, and the city of Chicago does not have the resources, it's likely the mayor will go around state government and take his case directly to Washington.
"Why should the people of Georgia and the rest of the nation cough up $20 billion to build an airport in Chicago, when their own state won't even pay for it?" continued Wilkinson. "Compare Chicago's project to Atlanta's request of $500 million for the new Hartsfield-Jackson international terminal. Atlanta and Chicago have virtually identical airports with identical traffic volume, yet Chicago's terminal will cost more than $19 billion more the proposed Atlanta project, and the airlines have affirmed that it will do very little to alleviate flight delays. The American people were right to stand up against the 'bridge to nowhere,' and it's time to do the same with the 'runway to nowhere.'"
Work on the next phase of the O'Hare expansion has not begun and funding for the $20 billion Program has not been secured. FAA studies show that the expansion will not provide any significant improvement of airline delays or alleviate congestion at O'Hare. Aviation experts say that OMP will instead produce massive delays and increase costs for both consumers and airlines during and after initial construction. In addition, the airlines, including United Airlines and American Airlines, have also called the OMP plan "ill-conceived" and "premature."
www.stop-omp.org is dedicated to stopping the senseless, ill advised and flawed O'Hare Modernization Program (OMP) and preventing further unnecessary displacement of families and the wasting of taxpayer dollars. Community leaders, concerned citizens, aviation industry leaders and economic experts continue to urge the FAA to adopt viable alternatives. These include runway configurations proposed by the Chicago air traffic controllers, use of congestion management techniques, reliance on other nearby airports, and construction of a third airport.

Bauer Calls Taxpayer-Funded Embryonic Stem Cell Research 'A Tragedy'
/PRNewswire/ -- Former Presidential candidate Gary Bauer on Monday called Barack Obama's decision to waste federal tax dollars on failed embryonic stem cell research "evidence that ideology is the goal here, not saving lives. We are witnessing the beginnings of a tragedy, as lives will be lost and not saved as a result of this change."
The president of American Values made the following statement: "It's tragic that Barack Obama is willing to take tax money from struggling Americans and give it to scientists working on repeatedly failed embryonic stem cell projects...especially as adult stem cell research is yielding real, life-saving results. Most people do not understand that there is no restriction against fetal stem cell research, just a restriction against spending tax dollars to destroy human embryos for a body of work that has resulted in cancers and abnormal cells time and time again. Adult stem cell research, on the other hand, has provided real hope to many patients. In 2008, the National Institutes of Health spent nearly one billion dollars on stem cell research, most of it going to adult stem cell research because of the real hope it offered.
"This policy shift is part of an anti-life agenda that now will allow human embryos to be destroyed to create cell lines. My concern is that the long-term result of this work will lead to a lifting of the ban against human cloning, a development that would allow testing in laboratories on human embryos, human life. But today, Obama's decision to allow federal tax dollars to be used to destroy human embryos is tragic on many levels. He raises false hope for those who are ill; he strains the American taxpayer at a time of economic crisis, and he ignores the humanity of the lives ended in cold laboratories to satisfy a liberal ideology."
